Case No. 192 of 2025, registered for the offence under Sections 61(2), 103(1) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Koderma. 2. Learned counsel appearing for the petitioner submits that the petitioner happened to be the driver of the tractor in question and allegations are made that due to dash made by the said tractor, one person has died. He next submits that now the chargesheet has been submitted in the case and further the petitioner is in custody since 23.06.2025. 3. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner was driving the tractor in question. 4. Considering that the petitioner happened to be the driver of the tractor in question and due to the accident, the said death has been caused and further the petitioner is in judicial custody since 23.06.2025, I am inclined to release the petitioner, on regular bail.
