Kausik (Allowed) CRM (NDPS) 1172 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak P.S. Case No. 846/2021 dated 14.08.2021 under section 21(C)/29 of the NDPS Act. And In the matter of : Nayan Mandal ……Petitioner. Mr. Sobhan Majumder ……for the Petitioner. Mr. Anand Keshari ……for the State. Petitioner was absent on 02.05.2025 and warrant of arrest consequently was issued by the learned ADJ, 4th Court, Malda. Consequently, he was arrested on the basis of the warrant of arrest and produced on 28.07.2025. Petitioner is in custody since 28.07.2025. Having considered the petitioner was absent only on one occasion, I am inclined to release the petitioner on bail. Petitioner, namely, Nayan Mandal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court cum ADJ, 4th Court, Malda. 2 If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the District of Malda without the permission of the learned Special Court. Apart from the aforesaid conditions learned Trial Court would, if he deems fit and proper, impose other conditions as he considers necessary for ensuring the appearance of the petitioner regularly. With the aforesaid observations CRM (NDPS) 1172 of 2025 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
