This application has been filed by applicant for quashing the charge sheet dated 10-12-2019 alongwith cognizable/summoning order dated 24- 01-2020 as well as entire proceedings of the Case Crime no. 208 of 2019 (State versus Dr. Chandresh Upadhyay & others), under Sections 147, 341 I.P.C. & 6 Unlawful Activities (Prevention) Act & 7 Criminal Law Amendment Act, Police Station Siddharth Nagar, District Siddharth Nagar pending before the learned Chief Judicial Magistrate, Siddharth Nagar. 3. After some argument, learned counsel for the applicant prays that applicant may be permitted to move appropriate application before the Court concerned for discharge. 4. Learned A.G.A. for the State has no objection to the aforesaid prayer made by learned counsel for the applicant. 5. Considering the facts and circumstances of the case, the applicant is permitted to appear before the concerned court within 15 days from today and move an application claiming discharge. The concerned court shall after hearing the counsel decide the application on merits, in accordance with law expeditiously. 6. For a period of 30 days, no coercive action will be taken against the Versus Counsel for Applicant(s) : Digambar Dwivedi, Maya Pati Pandey Counsel for Opposite Party(s) : G.A.
