For Petitioner(s): U.Yuvaraj For Respondent(s): Mr.P.Dhileepan Government Advocate (Crl.Side) ORDER The petitioner, who apprehends arrest for the alleged offence punishable under Sections 274, 275, 123 of BNS and 24(1) of COTPA Act, 2003 in Crime No.674 of 2024 on the file of the respondent police, seeks anticipatory bail. 2. The case of the prosecution is that on 30.10.2024 when the police were on patrol duty, the Accused No.1 was found in possession of 15 Hans small https://www.mhc.tn.gov.in/judis CRL OP No. 5494 of 2026 __________ Page2 of 4 pockets in 10 pouches, 9 Cool Lip Filter small pockets in 8 pouches, 10 Vimal small pockets in 30 pouches, 10 V-1 small pockets in 30 pouches. Hence, the case. 3. The learned counsel appearing for the petitioner submitted that this is the second anticipatory bail petition and the earlier petition was dismissed by this Court in Crl.O.P.No.29747 of 2025 dated 31.10.2025; the petitioner has not committed any offence as alleged by the prosecution and has been falsely implicated in this case. Hence, he prays for the grant of anticipatory bail. 4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution's case, stating that 8 previous cases are pending against the petitioner, the petitioner is arrayed as A2. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. 5. Considering the submissions of the learned counsel on either side, it is noted that a huge quantity of banned tobacco products was recovered and 9 previous cases are pending against the petitioner, hence this Court is not inclined to grant anticipatory bail to the petitioner.
