1. The present writ petition has been filed under Articles 226 and 227 of the Constitution of India seeking the following directions:
“a) Issue a writ of Certiorari or any other appropriate writ, order or direction under Article 226 and 227 of the Constitution of India directing the Hon'ble Debt Recovery Appellate Tribunal to dispose of the miscellaneous appeal no.03/2023 titled "Axis Bank Ltd. vs. K C Sharma & others" in a time bound manner; (b) Any other order/s as this Hon'ble Court may deem fit and proper in favour of the petitioner and against the respondent;” This is a digitally signed order. 2. The learned counsel for the petitioner submits that the petitioner has already filed an appeal being Misc. Appeal no. 03/2023, assailing the Impugned Order before the learned Debt Recovery Appellate Tribunal (hereinafter referred to as, ‘DRAT’). However, the same has not been taken up for hearing and is still pending for adjudication.
3. The learned counsel for the petitioner, after arguing at some length, seeks permission of this Court to withdraw the present petition with liberty to file an urgency application before the learned DRAT seeking early hearing of the said misc. appeal.

Learned counsel for respondent has no objection to the same.
5. In view of the above, the petitioner is permitted to move an appropriate application with regard to their urgency before the concerned DRAT, Delhi.
6. As soon as the urgency application is filed, we expect the concerned DRAT to consider and pass an order in accordance with law as expeditiously as possible, without granting any unnecessary adjournments.
7. With the aforesaid directions, the petition, along with pending applications, stands disposed of.
