This petition has been filed assailing the order dated 29th July 2026 passed by Motor Accident Claims Tribunal (‘MACT/Tribunal’), Shahdara, Karkardooma Courts, in MACT No. 348/ 2025, whereby directions for disbursement and apportionment were issued in respect of the award amount of Rs. 40,00,000/-, which was agreed upon as part of the settlement before the Lok Adalat on 09th May 2026. 2. directions for disbursal as per the impugned order only provide for Rs. 2,00,000/- to be released to petitioner no. 1, who was the wife of the deceased, and the remaining amount was directed to be kept in a Motor Accident Claims Annuity Deposit (‘MACAD’) scheme comprising 190 equal monthly FDRs of Rs. 20,000/- each. 3. It is stated that the family of the deceased comprises his wife, petitioner no. 1; petitioner nos. 2 and 4, who are major daughters; petitioner no. 3, who is a major son; and two minor children, petitioner nos. 5 and 6. 4. In this circumstance, it is prayed that the that an amount be separated out for the minor children in order that it is kept protected for them till they attain the age of majority. Reliance can be placed on the decision of Supreme Court in General Manager, Kerala State Road Transport Corporation v. Susamma Thomas and Others, (1994) 2 SCC 176, wherein it was held that the compensation awarded to the minors should invested in long term fixed deposit till the minor children attain the age of majority. 5. Furthermore, it is also prayed that some amount be released to the children who have attained the age of majority and a larger amount be released to the widow in order to enable her to meet her liabilities, debts and expenses of running a large family. 6. Accordingly, the following directions are passed: i. Rs. 15,00,000/- out of Rs.
40,00,000/- as awarded by the MACT and deposited by the Insurance Company, is apportioned to petitioner no. 1/ the widow. A sum of Rs. 5,00,000/- along with accrued interest thereon shall be released as lump sum to petitioner no.1. The balance amount shall be kept in equal monthly FDRs for the period of 75 months, within interest This is a digitally signed order. accrued thereon being released to the Savings Bank Account of the petitioner no. 1. ii. Rs. 5,00,000/- along with accrued interest are apportioned to each of the children who have attained majority, being petitioner nos. 2, 3 and 4, out of Rs. 40,00,000/- deposited by the Insurance Company. A sum of Rs. 1,00,000/- each along with accrued interest thereon shall be released in the designated accounts of the children who have attained majority, and the balance amount of Rs. 4,00,000/- shall be kept in 25 equal monthly FDRs, with the interest accrued thereon being released to each of their Savings Bank Account. iii. A sum of Rs. 5,00,000/- each, along with accrued interest thereon, is apportioned to the minor children/petitioner nos. 5-6 and shall be kept in interest bearing FDRs till they attain majority. 7. Ms. Mouli Sharma, counsel, appears for the Insurance Company. 8. Accordingly, petition is disposed of with the aforesaid directions. 9. Copy of the order be sent to Manager, UCO Bank, Karkardooma Court Branch in order to ensure compliance of the aforesaid directions. 10.
