HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 40484 of 2026 Court No. - 36 HON'BLE SAURABH SHYAM SHAMSHERY, J.
1. Heard Sri B.J. Verma, learned counsel for petitioners and S/Sri Sunil Dubey and Anubhav Singh, learned advocates for respondents.
2. The petitioners before this Court are not bonafide litigants. They have made categorical averment in paragraph 6 of writ petition that order dated 19.04.1973 passed in Appeal No. 161/1971 was not challenged before any Court whereas learned advocates for contesting respondents have placed on record a memo of Second Appeal No. 1726/1973 challenging said order, which was allowed vide order dated 16.07.1981. Copy of memo of appeal as well as its order are kept on record.
3. It may be a case of petitioners that they were not party before this Court, still a statement made without verifying before this Court as well as with a declaration in affidavit that it was true to their personal knowledge, is nothing but to play a fraud with this Court, which cannot be permitted.
4. Considering overall circumstances, this Court does not have any reason to consider present writ petition, therefore, not only this writ petition is dismissed but it is dismissed with cost of Rs. 5,000/- on each petitioner which shall be deposited before High Court Legal Services Committee within four weeks.
