The petitioner participated for recruitment in the post of Constable (GD). He stood disqualified as his height measurement was found to be 169.8 cm and on re-measurement by the appellate authority it was found to be 169.7 cm. 2. It has been submitted that as per the guidelines 2(d) for recruitment medical examination in CAPF, while measuring height, fraction of centimeter less than 0.5 will be ignored and 0.5 cm and more will be rounded off to the next higher centimeter. 3. It has been submitted that as the petitioner has been found to be deficient with only 0.2/0.3 cm, the same ought to be rounded off to the next higher centimeter, i.e., 170 cm which is the required height. 4. In support of such submission, learned advocate for the petitioner relies on the judgment passed by this Court in a batch of writ petitions first of which is WPA 21766 of 2025 [Anuj Bala vs. Union of India & Ors.] which stood disposed of by the Court on September 12, 2025 by holding that the candidates whose height
2 has been recorded as 169.5 cm and above but below 170 cm are declared eligible for the detailed medical examination. 5. The judgment passed by the Hon’ble Bombay High Court on the same lines on October 1, 2025 in the Writ Petition No.12664 of 2025 [Sushant Bhausaheb Sarode vs. Union of India & Ors.] and the Special Leave Petition preferred by the Union of India against the judgment in the matter of Sushant Bhausaheb Sarode (supra) has been relied upon. 6. Prayer has been made to direct the authority to treat the petitioner as eligible for the next stage of the recruitment process. 7. Learned advocate representing the Union of India submits that a batch of appeals first of which is MAT 1687 of 2025 [Union of India vs. Debasish Roy] over the selfsame issue is pending consideration before the Hon’ble Division Bench of this Court. 8.
Upon hearing the submission made on behalf of the parties and on perusal of the relevant guidelines, it appears that the guidelines specifically mention as regards rounding off the measurement if the same is found to be less than 0.5 cm. 9. In the instant case, the height of the petitioner has been found to be less than 0.2/0.3 cm than the minimum required height of 170 cm. 10. The authority ought to act in terms of its own guidelines and round off the height to the next higher
3 centimeter, i.e., 170 cm which makes the petitioner eligible to appear for the next stage of the recruitment process. 11. The judgment passed by this Court in the matter of Anuj Bala (supra) and the Hon’ble Bombay High Court in the matter of Sushant Bhausaheb Sarode (supra) are also on the same line. 12. In view of the above, the instant writ petition stands disposed of by holding that the authority would be bound to act in terms of its guideline 2(d) and round off the height of the petitioner to the next higher centimeter. 13. The petitioner shall be treated as eligible in terms of height and entitled to participate in the next stage of the recruitment process. 14. Writ petition stands disposed of. 15.
