Order 01/04/2026
1. The petitioner has preferred this bail application under Section 482 of BNSS in FIR No.422/2022 registered at Police Station Sapotra, District Karauli for the offences under Sections 394, 307, 455 and 34 of IPC, 1860 and Sections 3, 25 of Arms Act,2019.
2. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present matter. He again submits that in the present matter, the co-accused Raghu has been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 31.08.2023. He contends that the petitioner had no role in the commission of the offence and has been implicated in this case without any cogent ground. It is further contended that the
[2026:RJ-JP:13584] (2 of 2) [CRLMB-1754/2026] petitioner is ready to cooperate with the investigation and, therefore, may be entitled to the benefit of anticipatory bail.
4. On the contrary, learned Public Prosecutor submits that the petitioner had an active role in the commission of the offence and his name emerged during the interrogation of the other co- accused. He further submits that the other co-accused named in the FIR have been granted the benefit of regular bail not of anticipatory bail. It is submitted that custodial interrogation of the petitioner is required; therefore, the benefit of anticipatory bail may not be entitled to present petitioner.
5. On consideration of the rival submission and material available on record and in light of submissions made by learned Public Prosecutor especially prima facie involvement of the petitioner and the case is related to the dacoity and custodial interrogation is required, but without expressing any opinion on the merits/demerits of the case, I am not inclined to grant benefit of anticipatory bail to the petitioner.
6. Accordingly, the bail application under Section 482 B.N.S.S. is dismissed.
