Order 24/08/2026
1. The instant writ petition has been filed challenging the order dated 06.12.2024, whereby the Original Application filed by the petitioner was dismissed by the learned Central Administrative Tribunal, Jaipur (for short 'Tribunal').
2. The brief facts of the case are that the Railway Recruitment Cell, North Western Railway, Jaipur, issued notification No.03/2013 dated 14.12.2013 for recruitment to fill up 917 vacancies on various posts carrying Grade Pay of Rs.1,800/-. Pursuant to the said advertisement, the petitioner applied for the said posts under OBC category. The petitioner, thereafter, appeared in the written examination and, having been qualified therein, he appeared in
[2026:RJ-JP:34433-DB] (2 of 5) [CW-2579/2025] the Physical Efficiency Test (PET), followed by a medical examination. In the said medical examination, the medical authority declared the petitioner unfit, and the medical certificate to that effect was issued on 21.09.2015. On the basis of the said medical certificate, the respondents rejected the candidature of the petitioner on the ground that he was medically unfit for the notified posts.
3. Being aggrieved by the said rejection, the petitioner filed Original Application No.862/2016 before the learned Tribunal. By
order date 18.10.2023, the learned Tribunal disposed of the said application with a direction to the respondents to conduct a re- medical examination of the petitioner by an independent medical board other than the medical board of railways. In compliance of the said order, the respondents got the petitioner re-examined by the medical board of Sawai Mansingh Hospital, Jaipur (for short 'SMS Hospital'), wherein the petitioner was found fit for the non- technical services not included in public safety. Consequently, the respondents, vide order dated 24.04.2024, rejected the candidature of the petitioner.
4. Being aggrieved by the said order, the petitioner filed another Original Application, being O.A. No.720/2024, before the learned Tribunal. The said original Application was also dismissed by the impugned order. Hence, the present writ petition.
5.
Learned counsel for the petitioner submitted that the petitioner fulfills the eligibility criteria for appointment to the notified posts. He further submitted that, in the re-medical examination, conducted by the medical board of SMS Hospital,
[2026:RJ-JP:34433-DB] (3 of 5) [CW-2579/2025] Jaipur, the petitioner was found fit for a non-technical post and, therefore, he was entitled to be appointed against the non- technical posts, namely, Helper/Khalasi/Safaiwala/H.A. He also submitted that the learned Tribunal had grossly failed to consider this aspect and, therefore, prayed that the present writ petition be allowed and a direction be issued to the respondents to appoint the petitioner against a non-technical post. 6. On the other hand, learned counsel for the respondents, while supporting the order passed by the learned Tribunal, submitted that subsequently, the medical board, vide its letter dated 26.03.2024, on the basis of the Indian Railway Medical Rules, Part-I, 2000 (for short, 'Rules of 2000'), recommended that the petitioner is found fit in medical category C-2. He further submitted that none of the notified posts advertised vide notification dated 14.12.2013 falls under medical category C-2. He, therefore, prayed for dismissal of the writ petition. 7. We have heard learned counsel for the parties and perused the material available on record. 8. The requisite medical standard for the posts advertised, as provided in the advertisement dated 14.12.2013, is as under:- S. No. Name of Posts Medical Standard
1. Trackman B1
2. Traffic Khalasi/Pointsman A2
3. Gate Man A3
4. Helper/Khalasi B1
5. Helper/Khalasi/Safaiwala/H.A. C1
9. In the instant case, by an earlier order dated 18.10.2023 passed in O.A. No.862/2016, the learned Tribunal directed the respondents to get the petitioner re-examined by an independent
[2026:RJ-JP:34433-DB] (4 of 5) [CW-2579/2025] medical board other than that of railways. In compliance of the said order, a medical board was constituted at SMS Hospital for re- medical examination of petitioner. By letter dated 24.02.2024, the medical board opined as under:
“The candidate is UNFIT for technical services and non- technical services which are included in public safety/ require stereoscopic vision. Only fit for non technical services not included in public safety like account and store services. The final decision rests with the appointing authority.”
10.
However, since the report did not specify the medical category, from A-1 to C-2 under the Rules of 2000, in which the petitioner fell, nor did it specify the posts for which the petitioner could be considered medically fit, the respondents, vide letter dated 05.03.2024, sought clarification from SMS Hospital regarding the medical category of the petitioner. In response thereto, the medical board, vide its letter dated 26.03.2024, clarified that in terms of Para 512 of the Rules of 2000, the petitioner was found fit under medical category C-2. 11. The case of the petitioner is that, having been found fit for non-technical services in the medical examination, he could be appointed to any of the posts of Helper/Khalasi/Safaiwala/H.A. However, a perusal of the advertisement indicates that candidates applying for even the aforesaid posts were required to fulfil the medical standard of category C-1. Admittedly, the petitioner has been found fit only under medical category C-2 and, therefore, does not fulfil the requisite medical standards prescribed for the said posts. It is further evident from a perusal of the
[2026:RJ-JP:34433-DB] (5 of 5) [CW-2579/2025] advertisement that no post carrying the medical standard of category C-2 was advertised under the said notification. 12. In that view of the matter, we are of the considered opinion that, on the basis of the medical re-examination, the petitioner is not eligible for appointment to any of the notified posts under the aforesaid advertisement. Besides above, this Court finds that the present recruitment process, which began in 2013, had already been completed in 2014, and thereafter, fresh recruitment notifications were issued in the subsequent years, i.e., 2018, 2019, 2024, and 2025. 13. As a result of above discussion, we are not inclined to interfere with the order passed by the learned Tribunal. 14. Accordingly, the present writ petition, being devoid of merit, is dismissed. 15. Pending applications, if any, stand disposed of. (SANDEEP TANEJA),J (INDERJEET SINGH),J 63/TN
