It is the contention of learned counsel for applicant that the accused applicant and informant are relatives. The FIR is lodged belatedly on 28.07.2026 by informant Srimati against six accused persons for cheating on 23.04.2026 while executing the sale deed. It is alleged in the FIR that the accused applicant was instrumental in introducing the informant to the seller Kanhaiya for executing the sale deed, which was executed and registered on 23.04.2026. It is alleged in the FIR that the property, which was sold to the informant, was of Rs.7,60,000/- whereas the applicant has handed over Rs. 41,44,280/-. It is further contended that the amount has not been transferred to the accused applicant and the allegation against co-accused Bittu @ Bihari is that the informant has handed over the money to Bittu @ Bihari and the other accused persons had distributed the same among them. It is further contended that there was an initial FIR lodged by the mother of informant against the accused applicant that accused applicant has forged a Will. This case was ended in submission of final report. He further submits that if there is an FIR against him then how the informant could rely on the accused applicant and could enter Versus Counsel for Applicant(s) : Arfi, Ram Jatan Yadav Counsel for Opposite Party(s) : G.A. Jugendra @ Jogendra Singh .....Applicant(s) State of U.P. .....Opposite Party(s) into a sale deed at the pretext of the applicant. The applicant has criminal history of two cases, in one case final report is submitted and in one case he is on anticipatory bail. Investigation is continuing and applicant is co- operating in the investigation. The accused applicant is languishing in jail since 19.08.2026. He seeks enlargement of accused on bail. 4. Learned A.G.A. for State opposed the bail application. 5. This Court has taken into consideration the rival submissions made by learned counsel for the parties and perused the record. 6. Considering the complicity of the accused applicant, his role and there is nothing on record to show the trail of money being credited to the accused applicant, the accused/applicant is entitled to be released on bail. 7. Hence, without touching merit of the case, the bail application is allowed. 8. The accused/applicant be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned in view of observation made by the Supreme Court in its dictums of Girish Gandhi Vs. State of Uttar Pradesh [(2024) 10 SCC 674] and Policy Strategy for grant of bail in re [(2024)10SCC 685]. 9. The accused-applicant shall cooperate in judicial process for fair and speedy disposal.
