Learned counsel for the petitioner submits that the petitioner was working with the respondent on the post of Chief Engineer with the respondent. Crime No.40/2000 under Section 13 (1) (Ã), 13 (2) of the Prevention of Corruption Act, 1988 was registered against him by the Special Police Establishment, Lokayukt, Bhopal, M.P. He retired on attaining the age of superannuation on 30/06/2005 from the post of Chief Engineer, T&D. After retirement, charge sheet of the abovestated offences was presented before the Special Judge, P.C. Act, 2 Rajnandgaon, C.G. on 29/03/2011 and vide order dated 21/01/2018, the petitioner was convicted for 2 years under Section 13 (ii) of the P.C.Act and was imposed with fine of Rs.25,000/-, in default, 6 months rigorous additional imprisonment. Thereafter, vide impugned order (Annexure P/1), as he was punished, his pension was withheld permanently. 3. Learned counsel for the petitioner further submits that the order of conviction of the petitioner, criminal appeal is presented before this Court i.e. Cr.A.No.377/2018, which is pending consideration. Learned counsel for the petitioner submits that during pendency of the writ petition, the sole petitioner has passed away. Thus, at present, this petition may be disposed off with liberty in favour of the legal representatives of the deceased petitioner to file a fresh petitioner after disposal of Cr.A.No.377/2018. 4. Not opposed by the other side. 5. Reserving liberty as aforesaid, this writ petition is disposed off.
