Nos. 6,7&8 : Mr. P.A.S.Pati, Advocate -- 06/12.02.2026 The instant writ petition has been preferred by the petitioners for the following reliefs: (i) For a direction upon the respondents to waive the Agriculture loan given to the petitioners through UCO Bank Deoghar as per loan waiver scheme of Govt. of Jharkhand (ii) For issuance of a writ in the nature of writ of certiorari to quash the certificate case initiated against petitioner no.-1,2,5&7 bearing certificate case no.-116/2016-17, certificate case no.-125/2016-17, certificate case no- 126/2016-17 and certificate case no.- 114/2016-17 respectively against the chairman of the self help group although the loan was given to all the members of self help group individually but certificate case have been initiated only against the chairman of the aforesaid self help group . 2026:JHHC:3925 3 2. At the outset, learned counsel for the petitioners submits that though there is specific resolution/notification of the Government to exempt the agricultural loan upto Rs. 50,000/- ; however, the same has not been done by the concerned Deputy Commissioner, Deoghar; as such, the concerned respondent may be directed to do the needful. They have also filed several representations, but the same has not yet been taken care of. 3. Learned counsel for the respondents submits that since no counter affidavit has been filed; as such the petitioners may be directed to file a joint petition before the Deputy Commissioner, Deoghar, who shall decide the issue on the basis of applicable rules/notification etc. 4. Having regard to the aforesaid facts and circumstances of the case, the instant writ application is hereby disposed of by giving liberty to the petitioners to file a joint representation before the respondent no. 4 raising their grievance what has been stated in the writ petition within a period of 8 weeks from today. If any such representation is preferred before the respondent no. 4, he shall look into the matter and pass an appropriate order in accordance with applicable rules. If the petitioners are entitled for the claim what has been prayed in the instant application, necessary consequential benefits be issued in their favour. 2026:JHHC:3925 4 The entire exercise shall be completed within a period of 16 weeks. 5.
