1. Petitioners herein seek quashing of FIR No. 349/2021 dated 09.09.2021, registered at Police Station Tigri, for commission of offences under Sections 354(A)/354(D)/509/506/34 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The complainant was, earlier, having a spectacle shop and petitioner No.2 used to visit her at the abovesaid shop in relation to repairing of his spectacles. He took her number and, thereafter, as per allegations appearing in the FIR, he started harassing her. He, even, threatened her to take back her complaint or else he would throw acid on her and would ruin her life. She also alleged that on basis of her one earlier complaint, when the police had called both the petitioners at Police Station, she was abused by them. She claimed that obscene messages were sent to her on Whatsapp and it is in the abovesaid backdrop that she approached the police to take legal action against both of them. 3. The FIR in question was registered on 09.09.2021. 4. The charges have already been framed and as far as petitioner No.1 is concerned, he has, merely, been charged for offence under Section 509 IPC whereas petitioner No.2 has been charged with all the said offences. 5. The quashing is being sought as the matter has been amicably settled between the parties. Copy of Settlement Deed dated 25.04.2026 is on record. 6. Petitioners are present in Court. 7. Respondent No.2 is also present in Court and has been duly identified by Investigating Officer. 8. When asked, respondent No.2 reiterated the terms and conditions of the settlement. She submits that since petitioners has expressed regret for their act and conduct, she has already accepted such apology and, therefore, she does not wish to pursue the matter against them.
She also submits that she is getting married very shortly and, therefore, she wants this case to get over, so she can live her future life in a peaceful manner. She states that she has entered into abovesaid compromise without any coercion and influence from any corner whatsoever and, therefore, they would have ‘no objection’ if the present FIRs in question are quashed. 9. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners. 10. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. Consequently, to secure the ends of justice, FIR No. 349/2021 dated 09.09.2021, registered at Police Station Tigri, for commission of offences under Sections 354(A)/354(D)/509/506/34 IPC, along with all consequential proceedings arising therefrom, are, hereby, quashed subject to petitioners depositing total cost of Rs. 20,000/- in the account of Delhi High Court Legal Services Committee within four weeks from today. 12. Proof of deposit of cost and original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within further period of two weeks, so that these become part of Trial Court Record. 13. The petitions stand disposed of in aforesaid terms. 14. Pending application also stands disposed of. (MANOJ JAIN) JUDGE
