...RESPONDENT(S):
The Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action on the part of the respondents No. 2 to 4 in interfering with our possession over the land about an extent of Ac.4.00 cents adjoined to the house sites allotted to us in an extent of Ac. 0.02 cents each in Sy.No. 3-13, Keelathoradi(Jogindlu) Village, Kammanapalle

Kammanapalle Panchayat, Baireddypalle Mandal, Chittoor District, without following due process of law and pass….”
2.
Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioners submits that the action of respondent Nos.2 to 4 in interfering with the peaceful possession and enjoyment of the petitioners over land admeasuring Ac.4.00 cents, adjacent to the house sites allotted to them to an extent of Ac.0.02 cents each in Survey No.3-13 of Keelathoradi (Jogindlu) Village,
Kammanapalle Panchayat, Baireddypalle Mandal, Chittoor District, is arbitrary and illegal. It is submitted that the petitioners have been using the said adjoining land for breeding cattle and that their request for allotment of the said land under Board Standing Orders 19-A is pending
consideration. Without disposing of the said application, the respondents are allegedly attempting to dispossess the petitioners. Hence the present writ petition.
4. On the other hand, the learned Government Pleader for Revenue appearing for the respondents placed before this Court written instructions dated 07.01.2026 issued by the Tahsildar, wherein it is stated that neither respondent No.1 nor respondent Nos.2 and 3 have ever interfered with the possession and enjoyment of the petitioners over the lands in Survey No.3/13 of Kammanapalli Revenue Village, Baireddipalle Mandal. It is further stated that certain neighbouring villagers belonging to Gopalapuram Village of Kammanapalli Revenue Village and Gadindlu Village of Settipalle Revenue Village had approached the revenue authorities seeking allotment of house sites in the lands comprised in Survey No.3/13. It is submitted that during the enquiry conducted by the revenue authorities, all such applicants were found to be ineligible for allotment of house sites as per the prevailing rules and guidelines. Despite being declared ineligible, the said neighbouring villagers attempted to forcibly encroach upon the subject lands, thereby creating law and order issues in the village. In order to
prevent illegal encroachments and to maintain public peace, a tom-tom announcement was made in the village cautioning the said villagers not to encroach upon the lands under any circumstances. It was also informed to the general public that house site pattas would be issued strictly in accordance with eligibility criteria, residence, and the rules in force, and that no person has any right to encroach upon Government or other lands without lawful authority.
5. In view of the submissions made by the learned counsel for the petitioners and the written instructions furnished by the learned Government Pleader for Revenue, this Court finds that no interference has been caused by the respondent authorities with the possession of the petitioners and that the steps were taken only to prevent illegal encroachments and to maintain law and order. Accordingly, the writ petition is disposed of, recording the assurance of the respondents that they shall not interfere with the possession and enjoyment of the petitioners, if any, except in accordance with law. There shall be no
order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
