Heard the parties. 2. It is the grievance of the petitioners that though the petitioner Nos.1 to 7 have been granted the benefit of 1st & 2nd ACP/MACP but not from the date when they were entitled. 3. So far as the petitioner Nos.8 to 10 are concerned, they have been denied the benefit of MACP on the ground that they have not passed the departmental examination. 4. Learned counsel for the petitioner submits that the petitioners have already filed a representation but the respondents are siting tied over the same and not taking any decision. 5. Learned counsel appearing on behalf of the State submits that if the petitioners individually file their representations, before the Principal Chief Conservator of Forest, Department of Forest, Environment of Climate Change, Govt. of Jharkhand -respondent No.3, their case will be considered and an 2026:JHHC:3667 3 appropriate order will be passed as per law. 6. Considering the submission of the parties, I direct the petitioners to file individual fresh representations within four weeks before The Principal Chief Conservator of Forest, Department of Forest, Environment of Climate Change, Govt. of Jharkhand -respondent No.3. On receipt of the said representations, the cases of the petitioners will be considered within six weeks and if it is necessary to place their cases before any committee or any authority, the same should be placed during the said period. 7. If it is found that the petitioners are entitled for any benefits, the same will be granted to them within two weeks thereafter. 8. If any part of the claim of the petitioners is rejected, the reasons should be communicated to the petitioners within the aforesaid period. 9. It is made clear that lack of necessary educational qualification should not come in the way of the petitioners for the relief which they have claimed as the Hon’ble Supreme Court in the case of “Amresh Kumar Singh Vs. State of Bihar & Ors. reported in 2023 SCC Online SC 496” has held that the requirement of educational qualification and passing of departmental examination is not necessary for grant of in situ promotion. 10.
