BEFORE HONOURABLE MR. JUSTICE SANJEEV KUMAR SHARMA ORDER Date : 15.09.2026 Heard Mr. P. Bharadwaj, learned counsel for the petitioner. Also heard the learned Additional Public Prosecutor appearing for the State. This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 whereby the petitioner, Shomesh Uddin Ahmed, has prayed for granting his bail after he was arrested in Barpeta Road P.S. Case No.86/2026
Page No.# 2/2 registered under Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act,
1956. The allegations as reflected in the FIR is that one prostitution racket was being run at a particular hotel in Barpeta Road and the same was raided by the members of an Organization and some girls and boys found engaging in illicit activities. It is submitted on behalf of the petitioner that the present petitioner is the owner of the building who had leased it out to the main accused and the same is also reflected in the grounds of arrest. The case has already been charge-sheeted and the main accused of the case has already been granted bail by the learned Court Below, i.e. the Additional Sessions Judge, FTC, Barpeta in Misc(Criminal) Bail Case No. 251/2026 dated 08.09.2026. The petitioner has been in custody since 45 days. Having regard to the period of detention, the prayer for bail is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing a bail bond of Rs. 50,000/- with two sureties of the like amount to the satisfaction of learned jurisdictional Magistrate/Court. Bail application stands disposed of.
