Also heard Shri Shailendra Sharma, learned PL, appearing for the respondent/State and Shri Rohit Sharma, learned counsel for respondents-2 to 4. 1. Petitioner has filed the present petition with the following prayer: “a. Kindly quash and set aside FIR No.0705 registered at City Kotwali Police Station, Bilaspur at about 00.56 hours on 25.12.2025 and FIR No.0706 registered at City Kotwali Police Station, Bilaspur at about 01:48 hours on 25.12.2025, along with all consequential proceedings arising therefrom, in view of the amicable settlement arrived at between the Petitioners and the complainant. b. To kindly pass any other order/s as this Hon’ble Court may deem fit, proper and just in the facts and circumstances of the present case, in the interest of justice.” 2. The Petitioners have filed the present petition seeking quashment of FIR No. 0705 dated 25.12.2025, registered at City Kotwali Police Station, Bilaspur, CG at about 00:56 hours, at the instance of the complainant, against all three Petitioners for the alleged offences punishable under Sections 296, 115(2), 351(2), and 3(5) of the Bharatiya Nyaya Sanhita, Crmp 691 of 2026 3 2023, read with Sections 25 and 27 of the Arms Act, 1959. The said FIR came to be registered in the backdrop of a sudden altercation arising out of a trivial and neighbourly misunderstanding between the parties, who are residents of the same locality. The incident, which occurred during the late hours of the night, unfortunately escalated into a verbal exchange and a minor physical skirmish, without any premeditation or criminal intent. In fact, on the very same date, at about 01:48 hours, Petitioner No. 1 also lodged FIR No. 0706 against the complainant at the same police station, setting out his version of the incident. Thus, the present matter involves cross-cases arising out of the same occurrence, namely, a scuffle between the parties, who are immediate neighbours. True copies of FIR No. 0705 and FIR No. 0706 are annexed herewith as Annexure P- 1 and Annexure P-2, respectively. Parties have amicably resolved their disputes and a joint application/representation along with personal affidavits has been placed on record, wherein both sides have settled the matter and do not wish to pursue the criminal proceedings against each other. 3. Learned counsel for the parties would jointly submit that they have amicably settled their dispute and therefore, petition may be allowed. 4. It transpires from the prayer made in the petition that two FIRs i.e. FIR No.0705 registered at City Kotwali Police Station, Bilaspur at about Crmp 691 of 2026 4 00.56 hours on 25.12.2025 and FIR No.0706 registered at the same Police Station at about 01:48 hours on the same day, which have been lodged by the parties against each other are sought to be quashed by this Court, which is not permissible as separate petitions should have been filed for both the FIRs lodged by either parties with proper array of parties. 5. At this stage, learned counsel for the petitioners seeks permission to withdraw the petition with liberty to file a fresh and duly constituted petition. 6. In view of the above submission made by learned counsel for the petitioners, the present petition stands dismissed as withdrawn with the aforesaid liberty, subject to the petitioners’ as well as respondents No.2 to 4 (both the parties) depositing a sum of Rs.20,000/- each of the complainants of the two FIRs, as cost before the Registry of this Court for wasting the precious time of Court in filing a petition in a casual manner. The receipt of such deposit shall be submitted at the time of filing the fresh petition, if any. 7. The amount so deposited shall be transmitted to the Government Special School for Visual and Hearing Impaired, Tifra, District-Bilaspur, CG. Crmp 691 of 2026 5 8. Certified copies of the documents annexed to the petition, if any, may be returned to learned counsel for the petitioners after retaining photocopies thereof on record.
