Heard the parties.

The petitioner, in this writ petition, prays that his application for grant of reconstitution of SKO Agency be accepted by the respondents.

Mother of the petitioner was the partner of SKO Agency who expired. Thereafter, this petitioner approached the respondents- Indian Oil Corporation Limited, for accepting the reconstitution of the partnership.

It is his grievance that his supply of kerosene oil has been stopped as the respondents are yet to accept the reconstitution on frivolous grounds.

Learned counsel appearing on behalf of the IOCL submits that as per the guidelines, the available surviving partner has to declare the name of other legal heirs of Late Khanjan Das, widow of SGT or to obtain succession certificate. The learned counsel further admits that in this case, the petitioner has approached them as one of the legal heir of the deceased and one of another sibling of this petitioner, who is the brother, has also approached, declaring himself to be the legal heir but he has not claimed any right.

Considering the said submission, since the petitioner has approached the respondents claiming his right and making a prayer for reconstitution of the partnership firm and the other legal heir of deceased has not made any claim, I direct the respondents to proceed upon the application of this petitioner and pass an appropriate order within six weeks from the date of receipt of a copy of this order.

The reasoned order should be communicated to the petitioner within two weeks thereafter and if the reconstitution is accepted, the supply of kerosene oil, should be resumed to the firm immediately without any delay.

With the aforesaid observation, this writ petition stands
disposed of.
