Deepshri W/o Navneet Kalbande Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order Mr. M.V. Rai, Advocate for applicant. Mr. A.P. Paliwal, Advocate for respondent.
CORAM : MEHROZ K. PATHAN, J.
DATE : 01/10/2026
1. This is an application for condonation of delay of 258 days in filing revision application. The revision is filed challenging the judgment and order dated 28.04.2025 granting final maintenance in favour of the respondent/wife. The applicant has deposited Rs.1,00,000/- directly in the account of the respondent/wife, to show his bonafide. The applicant has stated in the application that the ex-parte order was passed as the applicant has gone unrepresented before the Family Court and the applicant was thus unaware of the passing of the order passed by the Family Court. Hence, the revision could not be filed within time.
2.
Mr. Paliwal, learned counsel for the respondent/wife strongly opposes the condonation of delay application on the ground that the delay is not properly explained. The delay is deliberate and intentional. Despite service, the applicant has failed to remain present even before the Family Court while deciding the application. The 2026:BHC-NAG:13128
2 20.appr.104.2026.odt application for condonation of delay may therefore be rejected.
3.
I have gone through the application. The specific reasons are taken by the applicant that he was unaware of the proceedings before the Family Court. The applicant has also shown bonafide by depositing Rs.1,00,000/- directly in the account of the respondent/wife which is towards the arrears of maintenance.
4.
For the reason stated in the application the application is allowed. The delay of 258 days in filing the revision application is hereby condoned. The revision application be registered and listed for hearing on
07.10.2026.
