JUSTICE SANJEEV KUMAR SHARMA ORDER 15.09.2026 Heard Mr. Sayed Salim Ahmed, learned counsel for the petitioners. Also heard Mr. K K Parashar, learned Addl. Public Prosecutor for the State. 2. This is an application filed under Section 482 of the BNSS, 2023, for granting anticipatory bail to the petitioners in connection with Baihata Chariali P.S. Case No. 177/2026, registered under Sections 303(2)/325/299/317(4)/3(5) of the BNSS, read with Section 13(1) of the Assam Cattle Preservation Act, 2021, read with Sections 11(1)(a)/11(1)(d) of the Prevention of Cruelty to Animals Act, 1960. 3. It is the case of the petitioner that the informant of the instant case, one SI Dhanjit Deka, lodged a complaint before the Officer-in-Charge, Baihata Chariali P.S., on 08.08.2026, alleging, inter alia, that he received information from a reliable source regarding illegal slaughtering that had taken place under Baihata P.S. and he immediately conveyed the information to the CDSP, Rangiya, and at around 05:20 a.m., he, along with his team, proceeded towards Simelbari and, on reaching the spot, the informant party conducted a joint search operation of the premises of Saifuddin Ahmed, Mehebub Ali and Mehtab Page No.# 3/4 Ali and allegedly recovered a large number of cows and 343.83 kgs of raw beef meat, which were seized in the presence of independent witnesses. The informant further alleged that petitioner No. 1, along with others, tried to spy on the movement of the patrolling party and mislead them. On receipt of the said FIR, the O/C, Baihata Chariali Police Station, registered a case vide Baihata Chariali P.S. Case No. 177/2026 under the aforesaid sections and started the investigation. 4. The CD as called for has been received. 5. The learned counsel for the petitioners submits that as far as petitioner Nos. 2 & 3 are concerned, they are commercial bona fide purchasers of the cattle and, according to the learned Addl. Public Prosecutor, all the three petitioners were engaged as lookouts for the police movement. 6. Having regard to the nature of the allegations and the material against the present petitioners, their custodial interrogation may not be necessary. 7. Accordingly, the prayer for pre-arrest bail is allowed. 8. Accordingly, it is provided that in the event of their arrest, the petitioners shall be released on bail on furnishing a bail bond of Rs. 50,000/- (Rupees Fifty Thousand only) with two local sureties of the like amount, subject to the satisfaction of the arresting authority. Page No.# 4/4 9. It is provided herein that the petitioners shall appear before the I.O. within a period of 10 days from today. 10.
