Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioners have, inter alia, prayed for the following reliefs:- “A. That this Hon'ble Court may be pleased to issue the Writ in the nature of Mandamus or any other appropriate writ order or directions to the respondent to grant the benefit of contract service for the purpose of seniority and other consequential benefits for promotion and qualifying service for pensionary and other benefits. B. The respondents may be further directed to release the consequential benefits alongwith arrear alongwith interest @9% interest p.a.” 2. The representation filed by the petitioner has been rejected by the Authorities in terms of order dated 10.12.2024 (Annexure P-9). 3. Learned Counsel for the petitioners submits that in light of subsequent development as also the reply filed by the respondent- 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:26759 Board, in terms whereof, one of the reasons which led to the rejection of representation of the petitioner was the coming into force of Himachal Pradesh Recruitment and Condition of Scheme of Government Employees Act, 2024, which Act has been held to be bad by the Hon’ble Division Bench of this Court in CWP No.3361 of 2025, titled Devinder Kumar and others Versus State of Himachal Pradesh and another, alongwith connected matters, decided on 25.04.2026, the respondent-Board be directed to take a fresh call on the issue. 4. In light of the fact that in the earlier petition filed by the petitioners, this Court had directed the Board to decide the case of the petitioners in terms of the judgment of this Court in CWP No. 2004 of 2017, titled as Sh. Taj Mohammad and others vs. State of Himachal Pradesh and others with connected matter on 03.08.2023 and indeed, in the reply filed by the Board, it is mentioned that the petitioners were not entitled for any relief in light of the coming into force Himachal Pradesh Recruitment and Condition of Scheme of Government Employees Act, 2024, now as the Act in issue has been held to be bad in law by the Hon’ble Division Bench of this Court in CWP No.3361 of 2025 (supra), this petition is partly allowed by setting aside impugned order dated 10.12.2024 (Annexure P-9), with fresh direction to the Authority to take a call on the representation of the petitioner in light of Taj Mohammad’s case, within a period of eight weeks from today. 3 2026:HHC:26759 5.
