Petitioners claiming to be the owners of land bearing CTS Nos.95/71, 95/72 and 95/73 situated in Ward No.111, Hubli City, Dharwad Urban Property, Dharwad, totally measuring 24.5 guntas. That the respondent No.3-Karnataka Slum Clearance Board had acquired the said land. Petitioners were constrained to file a suit in O.S.No.393/2002, for the relief of permanent injunction in which the respondent No.3- Karnataka Slum Clearance Board had given an undertaking that it will proceed to acquire the aforesaid land in accordance with law, meaning thereby they would pay the compensation to the petitioners. 3. Learned counsel for the petitioners, drawing attention of this Court to a communication as per Annexure-J dated 28.01.2009 issued by the Office of Deputy Commissioner, Dharwad addressed to the respondent No.3-The Commissioner of Karnataka Slum Clearance Board and submits that the land being subject matter of petition has also been considered for - 4 - HC-KAR NC: 2026:KHC:8255 WP No.52777 of 2013 payment of compensation and if a direction is issued to the respondent No.3-Karnataka Slum Clearance Board to give effect to the said order, the purpose of the petition will be served. 4. In response, learned counsel appearing for the respondent No.3-Karnataka Slum Clearance Board submits that given some time, the representation of the petitioners as per Annexure-K would be considered in accordance with law. 5. There appears to be reference to certain lands bearing Nos.CTS/Survey Nos.95/72 and 95/73 with the measurement as quoted thereunder. 8. At this juncture, learned counsel for the petitioners submits that petitioners are also owner of land in CTS No.95/71, which he is also ready to offer the same for the respondent No.3-Karnataka Slum Clearance Board. 9. Be that as it is, since there is already a Communication issued as noted above, tentatively fixing the market price and compensation payable with respect to the property being - 7 - HC-KAR NC: 2026:KHC:8255 WP No.52777 of 2013 claimed by the petitioners and in the light of the submissions made by the learned counsel for the petitioners and respondent No.3-Karnataka Slum Clearance Board, petition is disposed of directing the respondent No.3-Karnataka Slum Clearance Board to consider the representation as per Annexure-K and pass appropriate orders in accordance with the applicable provisions of law with regard to payment of compensation as prevalent at present. 10. Such exercise shall be undertaken and order passed in this regard one way or the other shall be communicated to petitioners within an outer limit of six months from the date of receipt of certified copy of this order.
