Respondent(s) For Petitioner : Mr. Harsh Wardhan, Advocate For Respondent No. 1 to 3 : Ms. Anuja Sharma, P.L. For Respondent No. 4 and 5 Mr. Khilendra Sahu, Advocate SAURABH YADAV Digitally signed by SAURABH YADAV Date: 2026.02.11 11:07:31 +0530 2 HON’BLE SHRI JUSTICE BIBHU DATTA GURU Order on Board 10/02/2026 1. By the present writ petition, the petitioner is seeking a direction towards the respondent-Municipal Corporation, to convene the meeting of Departmental Promotion Committee (DPC) for the next higher post of Draftsmen within a stipulated period in accordance with the circular issued by the State Government on 18.05.2023. 2. The case of the petitioner as projected in the present writ petition is that initially he was appointed on 20.10.1992 on the post of Tracer in the respondent-Municipal Corporation (Earlier known as Bilaspur Development Authority). According to the petitioner, despite the fact that he is the most eligible and senior employee, he has not been promoted to the post of Assistant Draftsmen till 2017. Now, he is eligible for promotion to the post of Incharge Assistant Engineer. Learned counsel for the petitioner would submit that as per the Chhattisgarh Municipal Corporation (Appointment and Terms and Conditions of Service of Officers and Employees) Rule 2018, the Assistant Draftsmen who have rendered five years of service are eligible to the next higher post of Draftsmen. However, in the case of the petitioner, the same rule has not been followed and the petitioner has been deprived from his promotional avenues, inspite of the fact that he has rendered the services more than three decades in the department and is at the verge of retirement. According to the learned counsel, the Municipal Corporation is not convening the meeting of DPC, for the post of Draftsmen for the reasons 3 best known to them and the petitioner is being deprived from consideration for promotion to the said post. In support of his contention he placed reliance upon the circular dated 18.05.2023 (Annexure-P/6) wherein, strict guidelines have been issued for convening the DPC. 3. Learned counsel for the State has not opposed the circular issued on 18.05.2023. 4. Learned counsel appearing for the respondent-Municipal Corporation, though agreed to the circular issued by the State Government, however, submits that necessary steps shall be initiated to convene DPC for promotion to the post of Draftsmen, in accordance with law and as per the said circular. 5. In view of the submission made by learned counsel for the respondents, the writ petition is disposed of with a direction to the petitioner to submit a detailed representation before the respondent No. 4 and 5 within a period of 20 days and thereafter the said authorities are directed to take appropriate steps to convene DPC for the promotion to the post of Draftsmen, in accordance with law and in the light of the circular dated 18.05.2023 within a period of 30 days. The entire exercise be completed within a period of 50 days from today. 6. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities are directed to proceed with the matter strictly in accordance with the aforesaid circular.
