1. By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [“BNSS”], corresponding to Section 482 of the Code of Criminal Procedure, 1973 [“CrPC”], the petitioner seeks quashing of CR. Case No. 1274/2021, arising out of FIR No. 505/2020, dated 30.10.2020, registered at Police Station Laxmi Nagar, Delhi, under Sections 420/467/468/406/471/506/120-B of the Indian Penal Code, 1860, and pending before the learned Judicial Magistrate First Class, East, Karkardooma Courts, Delhi, alongwith all consequential proceedings arising therefrom.

CRL.M.C. 6140/2026 petitioner, submits that he does not wish to press the present petition. He, however, seeks liberty to raise all rights and contentions available to the petitioner before the learned Trial Court, including at the stage of
consideration of the charge/discharge application, as and when the same arises.
3. The present petition, alongwith the pending applications, is dismissed as not pressed, in view of the aforesaid submission.
4. It is clarified that this Court has not issued notice to respondent No. 2/complainant in the present proceedings. Accordingly, all rights and
contentions of the parties are left open for consideration by the learned Trial Court on merits and in accordance with law.
5. Mr. Bagga further submits that, if the need arises, the petitioner may seek exemption from personal appearance on any particular date of hearing. The petitioner is at liberty to move an appropriate application before the learned Trial Court in this regard, which shall consider the same in accordance with law.
6. It is clarified that this Court has not expressed any opinion on the merits of the case.
