Respondents ---- CORAM: HON’BLE MR. JUSTICE SUJIT NARAYAN PRASAD HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI --- For the Petitioner :- Mr. D.K. Dubey, Advocate. For the State :- Mr. Srikant Swaroop, A.C. to A.A.G.-II For the RIMS :- Dr. Ashok Kumar Singh, Advocate. ---- 09/12.03.2026 This contempt petition has been filed against the opposite parties to suitably punish them for their willful disobedience and deliberate non-compliance of the order dated 11.08.2023 passed by this court in L.P.A. No. 565 of 2022. 2. Mr. Dubey, learned counsel appearing for the petitioner has submitted that the direction made in para-62 of the order passed in L.P.A. No. 565 of 2022 has not been complied with in its letter and spirit. He further submitted that out of eight petitioners, seven petitioners have already been appointed and only one petitioner has not been appointed. Submission has been made, representing the petitioner herein is that the petitioner is also eligible candidate on the basis of experience certificate and other [2026:JHHC:6642-DB] -2- testimonials attached with his application. It has been submitted that no finding has been arrived that the document pertaining to experience has been found to be forged and improper and for that the petitioner has not been appointed. 3. The matter was earlier heard on 17.02.2026 and on that day, it was alleged on behalf of the petitioner that the appointment has been made to the applicants, who have even not made applications in pursuance to advertisement No. 955(c). This court in order to ascertain the aforesaid fact has directed the learned counsel appearing for the RIMS to come up with the records, particularly with the original applications so as to compare with the candidates, who have been appointed, based upon the applications submitted pursuant to that advertisement. 4. Dr. Ashok Kumar Singh, learned counsel appearing for the RIMS has submitted that the said applications are with him and none of the applicants have been found that who have said to be not made applications in pursuance to advertisement No. 955(c), have been appointed, which is the subject matter of recruitment process. He next submitted that the selection has been made purely on the basis of guidelines after scrutinizing the applications furnished by the candidates afresh, as also experience certificate and the other testimonials attached with their applications and thereafter the appointment has been made on the basis of performance of other candidates. 5. So far as the concern of this court to punish the erring officials, who have been found to be indulged in committing irregularity in the selection process, a departmental proceeding has been initiated against the erring officials and the same has been culminated into the order of censure. 6. The submission therefore has been made that the order has been substantially complied with, as such, nothing survives in the present contempt petition. 7. We have heard the learned counsel appearing for the [2026:JHHC:6642-DB] -3- parties and gone through the order passed by this court in L.P.A. No. 565 of 2022 and particularly the directions passed in para-62 thereof, this court after taking this issue on merits, has directed opposite party-RIMS to scrutinize all the applications of the applicants afresh as per the advertisement. It has further been directed to scrutinize the experience certificate and other testimonials attached with their applications properly and weed out the forged / improper one. It has also been directed that if the experience certificate, is found to be forged, the candidature of such candidate must be rejected outrightly by taking consequential follow-up legal action against such candidate, if required. Further direction is made to take appropriate legal action by identifying the officers / staffs, who were / are involved in the faulty process of selection so as to deal with properly in accordance with law. 8. So far as imposing the punishment upon the erring officials are concerned, it has been stated in the show cause that the departmental proceeding has been initiated, which has been concluded in the order of censure against the erring officials and further so far as issue of selection / appointment of other candidates are concerned, the directions recorded in para-62 of the order of the Division Bench have to be complied with strictly and all the applications of the applicants are directed to consider afresh along with experience certificate and the other testimonials attached with their applications and the selection process has to be made on the basis of assessment of one or other candidate. Initially eight petitioners were there, out of which, seven petitioners have already been appointed leaving one candidate, who is petitioner herein. 9. This Court is of the view that the ground which has been taken on behalf of the petitioner as has been referred hereinabove, can be a fresh ground to be agitated before the appropriate forum, since in the contempt proceeding, there cannot be any further direction merely on the ground that the selection of [2026:JHHC:6642-DB] -4- one candidate has not been culminated in the issuance of order of appointment letter. 10. In view of the fact that the order of this court has been substantially complied with based upon the assessment of the other candidates on merits and it is not the case where the proceeding is to be proceeded further. 11. Accordingly, this contempt petition is disposed of. The petitioner is at liberty that if he is having any grievance with respect to selection process to approach before the appropriate forum.
