MARADA GOVARDHAN VARMA Counsel for the Contemnor: 1. 3 CMR,J & GTK,J C.C.No.325 of 2026 The Court made the following: ORDER: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) As per order dated 22.12.2025 passed in writ petition No.29623 of 2025, this Court has directed respondent No.5 to deliver the custody of the child to the petitioner through respondent No.4-Station House Officer of Patamata Police Station, on or before 24.12.2025 by 5.00 P.M. 2. This contempt case has been filed stating that there is a delay in giving custody of the child. It is stated that the custody of the child was given on 04.01.2026. But the fact that is established here is that the order of the Court is complied with and custody of the child has been given to the petitioner in compliance of the order of the Court. Simply because there is delay of 10 days in giving custody of the child, it cannot be said that there is any deliberate disobedience of the order of the Court, so as to haul up the respondent for contempt of Court. If the respondent offers any explanation for the delay, the same can be condoned. 3. Therefore, we do not find any valid ground to initiate contempt proceedings against the respondent. 4. Therefore, the Contempt Case is dismissed. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. ________________________________________ JUSTICE CHEEKATI MANAVENDRANATH ROY _____________________________ JUSTICE TUHIN KUMAR GEDELA Date: 31.01.2026 MDP
