The petitioner is before this Court seeking the following prayers: a) “to issue a writ in the nature of certiorari or any other order, direction or appropriate relief to quash the complaint dated 11.09.2025 filed by respondent No.2 (Annexure “A”); b) to issue a writ in the nature of certiorari or any other order, direction or appropriate relief to quash the FIR bearing Crime No.0080/2025 dated 11.09.2025 for the alleged offence under Section 66(C) and 66(D) of the Information Technology Act and Section 318(4) of the BNS, 2023 which was filed by respondent No.1 on the basis of the complaint of respondent No.2, pending before XXXVII Addl. CJM, Bengaluru. (Annexure B); c) grant any such order, direction and/or any other relief or reliefs as this Hon'ble Court deems fit and necessary, in the facts and circumstances of the case in the interest of justice.” 2. Heard the learned counsel for the respective parties and perused the material on record. - 4 - HC-KAR NC: 2026:KHC:16973 WP No. 5485 of 2026 3. Qua the other accused, the proceedings have stood closed on account of the joint compromise between the parties. The joint compromise records the closure of the proceedings against all the accused. 4. The memorandum of joint compromise petition, which is extracted in the order in Criminal Petition No.17371 of 2025 (disposed on 06.01.2026), reads as follows: "MEMORANDUM OF JOINT COMPROMISE PETITION The Petitioner and the Respondent No.2 herein above pray as follows: “1. It is submitted that, the Petitioner is implicated in the Crime No.80/2025, Dated: 11/09/2025 on the complaint of the Informant against petitioner and others and same was registered by the respondent under Offence under Section 66(c) and 66(d) of Information Technology Act and Section 318(4) of Bharatiya Nyaya Sanhita, 2023, pending before the Hon'ble XXXVII Addl. Chief Judicial Magistrate, Bengaluru. 2. It is alleged in the complaint that, he is residing at the address as shown in the complaint and running a business in the name of Bio Likwa Research Pvt. Ltd and holding a position of Director and he is having friend namely Tejaswi and during March 2025, he asked the informant to invest online - 5 - HC-KAR NC: 2026:KHC:16973 WP No. 5485 of 2026 betting and to earn crore money and based on the same on 13/06/2025, he searched through google online betting and got a call from 9901555553 and he introduced himself as Shashikiran and told about Tamil Nadu Premiere and if the informant invest amount, he will get double amount and if anything goes wrong, he is responsible for the same and based on the same, on 13/06/2025 from the account of Axis bank Account bearing No.924010010586938 he transferred Rs.30 Lakhs etc are alleged. 3. 3. It is further alleged that, after the same through whatsapp, he sent link of http://roarexchange.com link and on 25/06/2025 at about 7pm he opened the said link and got the match details of Trichy Grand Cholas V/s Madurai Panthers and he played for Trich grand cholos and won the match at about 11 hours, shashikiran sent message stating congrats and on 26/06/2025 he told that, he will send amount of Rs.50 lakhs, but the same was not remitted and he did not bring the amount too and tried contacting him, but he did not responded and given abnormal replied and later lodged complaint etc are alleged in the complaint. 4. Based on the above complaint, the respondent police have registered a false case against the petitioner initially and later as per the statement of the Accused No. 1, Accused No.2 is implicated in Crime No.80/2025 for an offence punishable under Section 66(c) and 66(d) of Information Technology Act and Section 318(4) of Bharatiya Nyaya Sanhita, 2023. Hence the petitioner is approaching before this Hon'ble Court among other facts and grounds. 5. Based on the above complaint, the respondent police have registered a case against the Accused No.1 namely Shashikiran and subsequently, the respondent police have given requisition to add the petitioner as Accused No.2 and one more person namely Vivek patil in the said crime based on the statement of the Accused No.1. Since, the Petitioner herein has settled the entire amount and - 6 - HC-KAR NC: 2026:KHC:16973 WP No. 5485 of 2026 same is settled and transferred through the DD No.890430, for a sum of Rs.30,00,00/-, DD No.890428, for a sum of Rs.30,00,000/- DD No. 890429, for a sum of Rs.40,00,000/- and in total the Petitioner transferred a sum of Rs.1,00,00,000/-in favour of the Respondent No.2 and same is remitted to his account. Since there is no any kind of further claim by the respondent No.2 against any of the accused nor any third person, the Respondent No.2 is consenting the above petition and same may be quashed the entire proceedings and the Respondent No.2 is not having any kind of future claims in any kind against the petitioner or any other accused in the above crime in any kind. Hence this Joint Petition. 6. It is submitted that, the informant undertakes that, they he will not file any other case pertains to the above subject matter in any kind. Hence this petition. 7. It is submitted that, this is the full and final settlement between the petitioner and the respondent No.2 in all aspects and there is no claim of any kind between the petitioner and the respondent forthwith. The respondent No.2 has also undertaken that he will not file any kind of cases against the petitioner on any of the reasons since this is the full and final settlement. 8. It is submitted that, the petitioner and the respondent No.2 have agreed and consented voluntarily by seeking leave of this Hon'ble Court to quash the FIR in Crime No.80/2025, Dated: 11/09/2025 for the offence punishable under Section 66(c) and 66(d) of Information Technology Act and Section 318(4) of Bharatiya Nyaya Sanhita, 2023 and the above petition may be allowed in terms of this Joint Compromise Petition. 9. It is submitted that, the above terms and conditions of this compromise petition are fixed and decided by both the petitioner and the Respondent No.2 with their free consent and without any coercion and undue influence. The Copy of the DD - 7 - HC-KAR NC: 2026:KHC:16973 WP No. 5485 of 2026 paid in favour of the Respondent no.2 is produced at Document No.1. Wherefore, the above petition filed by the Petitioner and the Respondent No.2 be pleased to permit to compromise and quash FIR Crime No.80/2025, Dated:11/09/2025, Registered by Shankarapura Police Station, Bengaluru, for the offence punishable under Section 66(c) and 66(d) of Information Technology Act and Section 318(4) of Bharatiya Nyaya Sanhita, 2023, pending before the Hon'ble XXXVII Addl. Chief Judicial Magistrate, Bengaluru, in the interest of justice.” 5. Admittedly, the petitioner had not filed the petition at that point in time. In that light, the benefit of the joint compromise petition must enure to the benefit of the petitioner herein as well. 6. For the aforesaid reasons, the following: ORDER i. The Criminal Petition stands disposed. ii. Proceedings pending in Crime No.80/2025 pending before the Hon'ble XXXVII Addl. Chief Judicial Magistrate, Bengaluru, for the offences punishable under Sections 66(c) and 66(d) of the Information Technology Act and Section 318(4) of Bharatiya Nyaya - 8 - HC-KAR NC: 2026:KHC:16973 WP No. 5485 of 2026 Sanhita, 2023 qua the petitioner- accused No.1 stands quashed. iii.
