Petitioner has filed this writ petition, seeking following reliefs:- “10.1 That, this Hon’ble court may kindly be pleased to issue an appropriate writ of certiorari quashing the impugned order dated 29.09.2025 (Annexure P/1) issued by the respondent no. 1 in the interest of justice. Learned counsel for the petitioner submits that petitioner who was earlier holding the post of Teacher is promoted to the post of Head Master, Middle School vide order dated 26.09.2013. Pursuant to order of transfer passed by State Government dated 28.01.2019 petitioner was transferred from Govt. Middle School Itwar Block Kuakonda District Dantewada to the post of In-charge Assistant Block Education Officer District Bastar on administrative ground. Since then petitioner was holding the post of In-charge Assistant Block Education Officer. Vide order dated 03.07.2020 petitioner was ordered to take the charge of Block Education Officer as In charge Block Education Officer and he was also given the financial charge. Petitioner since 2020 was performing the duties as In- charge Block Education Officer. Pursuant to order Annexure P-1 respondent no. 3 has been transferred who is holding the post of lecturer, to the office of Block Education Officer, Kuakonda as In- charge Block Education Officer. Petitioner and respondent no. 3 are holding the similar post in the cadre and next promotional post of petitioner as also the respondent no. 3 is of Principle and therefore, it cannot be said that respondent no. 3 holding the superior post and therefore, the impugned order Annexure P-1 is bad in law. 3. Learned counsel for State opposes the submission made by learned counsel for petitioner and would submit that petitioner who is holding the post of In-charge Block Education Officer has been transferred vide order dated 10.07.2025 passed by State Government to the post of Head Master Govt. Middle School Itwar Block Kuakonda District 3 / 3 Dantewada on administrative grounds. However in this writ petition, there is no challenge to the order of transfer of petitioner. As petitioner has already been transferred by State Govt. petitioner cannot be permitted to challenge the order of transfer of respondent no. 3 who is also transferred by order of State Govt. 4. I have heard learned counsel for the respective parties. 5. The change of place of posting of petitioner is pursuant to the order of transfer dated 10.07.2025 passed by State Govt from the post of In- charge Education Officer Block Dantewada to the post of Head Master, Govt. Middle School, Itwara Block Kunvakonda District Dantewada. Head master is the substantive post of petitioner on which petitioner is transferred. The order of transfer of petitioner dated 10.07.2025 is not under challenge in this writ petition and therefore, posting of respondent no. 3 by way of transfer order passed by State Govt cannot be interfered with. More so petitioner is having no right to challenge the transfer order of respondent no. 3 when he has chosen not to challenge her own transfer from office of Block Education Officer as In- charge Block Education Officer to the Head Master, Middle School, Itawar Block- Kunvakonda, District Dantewada. 6. For the forgoing discussion, no relief as claimed for by petitioner can be granted. Accordingly, this writ petition being sans merit is liable to be and is hereby dismissed.
