No. 1804 of 2026) which has been filed to add an additional prayer on behalf of the petitioner so as to challenge the order of status quo passed by learned Executive Magistrate on 28.01.2026, whereby and whereunder, an order of status quo has been passed with respect to Mouza Chamgoura, Darun Balia, Thana No. 560, Jamabandi No.2, Dag Nos. 7, 10, 11, 13, 14, 15 and 12, area 21 Bigha and 15 Katha. 2026:JHHC:4395 2 1. It is submitted by learned counsel for the petitioner that in the earlier litigation wherein W.P.(C) No. 6139 of 2017 had been filed by this petitioner, a specific finding was recorded with respect to same plot of land in question was a “Pradhan ka Jote” land vide order dated 19.12.2023 and, therefore, the petitioner was not precluded from carrying out any construction activities in the said land. It is submitted that the order directing status quo without hearing the petitioner is in teeth of the order passed by this Court. 2. Having considered the submissions advanced on behalf of both sides, it appears that the matter is sub-judice before the Sub Divisional Magistrate, Mahagama, Godda in Misc. Case 137 of 2025, wherein a proceeding under Section 163 of B.N.S.S., 2023 has been drawn on 11.04.2025 and the same has not been finally disposed of. 3. In this view of the matter, learned Sub Divisional Magistrate, Mahagama, Godda is directed to dispose of the said case within a period of eight weeks from the date of receipt/production of copy of this order. 4. Both the parties are directed to appear before learned Sub Divisional Magistrate on 21.02.2026. In the event of the non-appearance of either of the party or both, the Court will proceed as per law, considering the fact that the parties had information about the hearing of the pending matter. 5. In the meantime, the order of status quo being in conflict with order passed by the court stands vacated. I.A. No. 1804 of 2026 stands disposed of. It is made clear that the observation made herein will not prejudice the finding of learned Sub Divisional Magistrate. Main writ petition {W. P. (Cr) No. 569 of 2025} accordingly stands disposed of.
