Hitesh Kumar vs. NHAI OMP (M) No. 161/2026 06.07.2026 Present: Mr. Sanjeev K. Suri, Advocate, for the applicant. Ms. Sneh Bhimta, Advocate, vice counsel for respondent No.1. Mr. Manish Thakur, Dy. A.G. for respondent No.2. OMP No. 243/2026 For the reasons stated in the application, the same is allowed and delay in re-filing the appeal is condoned. Application stands disposed of. OMP (M) No. 161/2026 The instant application has been filed for condonation of delay in filing the appeal. It has been averred that copy of the impugned judgment, dated 24.09.2025 was applied on 06.10.2025 and delivered on 29.12.2025. Immediately, thereafter prompt action was taken for institution of the appeal. However, due to poor health of the counsel for the applicant, the appeal could not be drafted and filed well in time Thus, the aforesaid delay is neither intentional nor deliberate, but has occurred due to unavoidable circumstances, which were beyond the control of the applicant. The learned counsel for the respondent has opposed the application. In view of the reasons stated in the application, more particularly, paras 2 and 3 thereof, which is duly supported by an affidavit, coupled with submissions made by the learned counsel for the applicant, delay in filing the main appeal is condoned. Appeal be registered. Application stands disposed of. Arb. Appeal No. /2026 Admit. Send for the records. List in due course. (Romesh Verma) Judge 06.07.2026 (pankaj)
