Order 01/04/2026
1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused-petitioner has been arrested in connection with FIR No. 43/2024 registered at Police Station Special Police Station (SOG), District ATS & SOG, Jaipur for the offences under Sections 419, 420, 467, 468, 471, 120-B of IPC and Sections 3, 4, 6, 7, 10 of the Rajasthan Public
[2026:RJ-JP:13468] (2 of 4) [CRLMB-11129/2025] examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is further contended that accused-petitioners are in custody since 01.08.2025 and 16.06.2025 respectively and charge-sheets have already been submitted on 14.10.2025. It is also contended that there are no criminal antecedents against petitioner Mukesh Saran. It is also argued that the charge-sheet itself is voluminous and trial of the case may take considerable time and after filing of the charge-sheet no witnesses have been examined till date, therefore considering the aforesaid fact, the bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that both the petitioners used malpractice in the PTI examination conducted by RSSMBS in the year 2022. The accused-petitioner Mukesh Saran is the main beneficiary and in place of him dummy candidate appeared in the examination. Petitioner Mukesh Saran served on the post of PTI for almost two years and accused petitioner Jagdish Saran assisted petitioner Mukesh Saran in the alleged offence, therefore, considering the gravity of the offence, the bail applications of the accused-petitioners deserve to be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the parties and looking to the fact that petitioners remained in custody for long and after submission of the charge-sheet trial has yet not been proceeded, therefore this court without commenting
