This contempt Case has been filed for initiation of contempt proceeding against the opposite parties for disobedience of order dated 10.09.2024 passed in Criminal Revision No.427 of 2020 by this Court. 2. Learned counsel for the petition has submitted that the Criminal Revision No.427 of 2020 was filed by the opposite party no.2 by challenging the order dated 29.05.2020 passed by the learned Sub-Divisional Magistrate, Giridih Sadar in case no.189 of 2020 by which the learned Sub-Divisional Magistrate, Giridih Sadar, after holding that the dispute matter relates to right, title and 2026:JHHC:15280 interest which is beyond the jurisdiction of the Court, directed to attach Khandoli Institute of Technology, Bengabad, Giridih under Section 146(1) of the Cr.P.C keeping the possession under the Circle Officer. 3. It is submitted that even certain events have taken place after the orders have been passed by this Court and the petitioner had apprised the authorities for taking action. 4. It is submitted that on 02.06.2025 again a letter was written by the petitioner Ashutosh Kumar Pandey ( Secretary of Vivekanand Educational & Charitable Trust) to SDM, DC and CO Bengabad, Giridih, stating that on several occasions dated 16.11.2024, 08.12.2024, 24.12.2024, 06.01.2025, 16.01.2025, 29.01.2025, 04.02.2025, 22.02.2025, 02.03.2025, 20.03.2025, 23.03.2025, 29.03.2025, 19.05.2025, wherein several times request have been made and even FIR has been lodged, however, no action is being taken by the authority. Hence, proceeding may be initiated. 5. Learned counsel for the State has opposed the petition and submitted that the order has been complied with. 6. Having heard learned counsel for parties and from perusal of the records of this case, it appears at that the Criminal Revision No.427 of 2020 was disposed of on 10.09.2024 passed by this Court with the following observations, as follows:- “79 ‘…… However, it will be disable that neither the petitioner-Arvind Kumar nor the opposite party no.2 Ashutosh Kumar Pandey in Cr. Revision No.427 of 2020 may reside in the Campus of Khandoli Institute of Technology, Bengabad, Giridih till the disposal of the Title Suit No.269 of 2016.’ 81 ‘…….. It will also be desirable that the petitioner- Arvind Kumar and the opposite party no.2 Ashutosh Kumar Pandey in Criminal Revision No.427 of 2020 and the petitioner – Lakshmi Kant Bharti in Cr. 2026:JHHC:15280 Revision No.776 of 2020 shall not indulge into any illegal or unwarranted activities so as to warrant any lawful action in future. None of the parties shall disturb the smooth running of the College including the petitioner-Arvind Kumar and the opposite Party no.2, Ashutosh Kumar Pandey in Criminal Revision No.427 of 2020 and the petitioner-Lakshi Kant Bharti in Cri. Revision No.776 of 2020 or any other persons also and the college of the student may run smoothly without disturbance from on or other side.” 7. It appears from the pleadings made in this Contempt case and submissions of learned counsel for the petitioner, that certain events have been taken place also and for which the matter has been informed to the Authorities concerned by the aggrieved person. 8. It further appears that the parties are in litigating terms and certain direction had already been passed in Criminal Revision No.427 of 2020 and hence the scope of the contempt petition cannot be enlarged. 9. Considering the above, this Court is not inclined to entertain this Contempt petition. 10. Accordingly, this Contempt Case (Civil) No.1448 of 2025 is, hereby, dismissed. (Sanjay Prasad, J.)
