In the present petition, the petitioner No. 1 is a registered educational institution running a Petitioner No. 2- Private Industrial Training Institute, which provides vocational education and training to students from various States. The petitioners, by way of this petition, have sought the following reliefs: “A) Direct the Respondents to recognize and continue the affiliation of Petitioner No.2's Industrial Training Institute for the year 2025-26 specifically for the Fitter Trade. B) Declare that the communication dated 20.11.2025 issued by Respondent No.4 regarding de-affiliation of Fitter Second Shift and request for transfer of student data is without lawful authority, illegal, and void and be further pleased 2026:BHC-NAG:8314-DB 2 921.wp.90.2026.odt to Quash and set aside the Show Cause Notice dated 21.11.2025 issued by Respondent No.3 to the Petitioner. C) Issue a writ of mandamus or any other appropriate writ, order or direction commanding the Respondents to allow Petitioner No.2 G S Private Industrial Training Institute, for the year 2025-26 for the Fitter Trade Shift to continue admissions and conduct training for the said courses. D) Allow the petition with cost. E) Grant any other relief which this Hon’ble Court deem fit and proper under the facts and circumstances of the case, in the interest of justice.” 3. The communication dated 20/11/2025, issued by respondent No.3-Deputy Director of Vocational Education and Training Institute, Nagpur to the petitioner No.2 depicts that on 10/02/2025 itself the second section was de-affiliated. The said communication is on record at Page 34 (Annexure F). The petitioners have not raised any challenge to the said de-affiliation. The justification which the petitioners are trying to put forth, in the present petition, is that no such de- affiliation letter was served upon the petitioners. 4. It is important to note that the petitioners are not disputing the receipt of aforementioned letter dated 20/11/2025, wherein there is a reference of de-affiliation on 10/02/2025. Nothing is brought on record to show that if such de-affiliation order was not received by the petitioners, they made application to the concerned authority for 3 921.wp.90.2026.odt providing copy or it was communicated that the petitioners never received any such order of de-affiliation. 5. On the contrary, after receipt of aforementioned letter dated 20/11/2025, the petitioners sought seven days time to make submission. 6. No reply or any explanation is brought on record to show that within seven days any such reply or explanation was submitted by the petitioners. 7. In the meantime, there was a request by the respondent No. 3 to transfer the students to some other institution which was also not complied with by the petitioners. 8. Thus, in absence of any challenge to the de- affiliation and since the time such de-affiliation remains in force, the above mentioned prayer clauses cannot be granted. 9.
