For the respondent: Mr. Raj Kumar Negi, Additional Advocate General. ________________________________________________ Sushil Kukreja, Judge By way of the instant petition filed under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 (hereinafter referred to as “BNSS”), the petitioner is seeking interim bail of 15 days, in case FIR No. 321/2022, dated 06.12.2022, registered at Police Station Nalagarh, District Solan, H.P., under Sections 302, 323, 504 and 34 of the Indian Panel Code (hereinafter referred to as “IPC”), on the ground that his father is seriously ill and has been 1 Whether reporters of Local Papers may be allowed to see the judgment? . 2 ( 2026:HHC:10212 ) admitted in Gurdev Hospital Nurpur Bedi, District Rupnagar, Punjab, in emergency on 19.03.2026 and has been kept on ventilator support. It has further been submitted in the bail application that condition of the father of the petitioner is very critical and he has to look after his father and wants to be with his father in this critical situation. 2. In the status report filed by the prosecution, the prayer made by the petitioner for interim bail has been opposed on the ground that in the event of petitioner being released on bail, he may threaten the prosecution witnesses. However, it is not disputed that father of the petitioner is admitted in the hospital and is on the ventilator. 3. I have heard learned counsel for the petitioner as well as learned Additional Advocate General and also gone through the material available on record. 4. It is not in dispute that father of the petitioner is seriously ill and has been admitted in Gurdev Hospital Nurpur Bedi, District Rupnagar, Punjab, in emergency on 19.03.2026 and has been kept on ventilator support and the petitioner wants to be with his father in this critical situation. 3 ( 2026:HHC:10212 ) 5. Hence, without going into the merits of the case, in the above backdrop, I am of the view that the petitioner should be granted interim bail for a period of fifteen days. The learned counsel for the petitioner expressed inability of the petitioner to furnish local surety of District Solan. Therefore, the petitioner, who is presently lodged in Sub-Jail Kishanpura, District Solan, H.P., is ordered to be released on interim bail under police escort for a period of 15 days. He shall continue to remain under police escort w.e.f. 7th April, 2026 to 21st April, 2026 and after the expiry of the said period, i.e. on 22nd April, 2026, the police escort will bring him back to Sub-Jail Kishanpura, District Solan, H.P. as per Jail Manual. 6. It is clarified that the interim bail is being granted in the peculiar facts and circumstances of the case and will have no bearing on the merits of the case.
