Neutral Citation No. ( 2026:JHHC:8686 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 820 of 2026 Birsa Tamba ... Petitioner Versus The State of Jharkhand … Opposite Party --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioner : Mr. Ritesh Kumar, Advocate For the State : A.P.P. --- Order No. 03 Dated 26th March, 2026 Heard the learned counsel appearing for the respective parties. The petitioner is an accused in connection with Sessions Trial Case No. 19 of 2025 arising out of Karra P.S. Case No. 27 of 2024, pending in the Court of learned District & Additional Sessions Judge-I, Khunti. The prayer for bail of the petitioner was earlier rejected in B.A. No. 10281 of 2024. Submission has been advanced by the learned counsel for the petitioner that he is in custody since 09.03.2024. It has further been submitted that the driver and the cleaner of the truck which was taken away by the miscreants, have been examined as PW-1 and PW-2 and both have been declared hostile by the prosecution. Learned counsel adds that some of the co-accused persons have been granted bail by this Court. Learned A.P.P. has opposed the prayer for bail of the petitioner and has submitted that out of four charge sheet witnesses, two witnesses have already been examined. It appears that the petitioner was apprehended with a truck and though the driver and the cleaner of the truck have been declared hostile, but the informant is yet to be examined. So far as the co-accused persons who have been granted bail are concerned, their cases are on a different footing to that of the present petitioner. On consideration of the above, I am not inclined to reconsider the prayer for bail of the petitioner which stands rejected at this stage. (RONGON MUKHOPADHYAY,J.) 26.03.2026 MK
