Heard Mr. Techi Topu, learned Counsel appearing for the accused applicant. Also heard Ms. T. Jini, learned Additional Public Prosecutor for the State of Arunachal Pradesh. The instant application under section 482 of the BNSS, 2023, seeking pre-arrest bail to the petitioner Miss Morik Pakam in the event of
Page No.# 2/3 her arrest in connection with Itanagar Police Station Case No. 131/2026, registered under Sections 409/420/120B of the IPC, 1860. The case arises out of an FIR lodged by Shri Rubu Gambo, Branch Manager, Apex Bank, Nirjuli alleging that the earlier Branch Manager Shri Pronob Das in connivance with one Smt. Morik Pakam, has misappropriated certain amounts by dishonestly transferring the same to the individual bank account of Smt. Moric Ponkon.
Learned counsel appearing for the accused applicant submits that the present accused applicant, namely, Ms. Morik Pakam, is not named in the FIR and Smt. Moric Pokon is a different person. It appears from the case diary that, during the course of investigation, it was found that the bank account had been opened in the name of Smt. Morik Pakam, but the identity and Aadhaar card used for opening the said account were those of the present accused applicant. It is further alleged that the amounts in question were transferred to the said bank account. This Court, by order dated 03.08.2026, has granted interim pre- arrest bail to the accused applicant, subject to the condition that she shall cooperate with the investigation and make herself available for examination before the Investigating Officer within 10 days from the date of passing of the said order. The case diary in the instant case has been received and the same has been perused. Ms. Jini, learned Additional Public Prosecutor for the State, submits
Page No.# 3/3 that the accused applicant of the instant case has not appeared before the Investigation Officer, in terms of the order dated 03.08.2026. She, therefore, submits that the interim pre-arrest bail granted to the accused applicant ought to be cancelled. Taking into account the submissions made by the learned counsel for the parties and upon perusal of the case diary, this Court is of the considered opinion that the accused applicant has not cooperated with the investigation as directed by this Court. In view of the aforesaid, the interim pre-arrest bail granted to the accused applicant by order dated 03.08.2026 is hereby recalled and cancelled. Accordingly, the interim pre-arrest bail order dated 03.08.2026 stands recalled and cancelled. JUDGE Comparing Assistant
