Heard Mr. M. Biswas, learned counsel for the petitioner. Also heard Ms. S. H. Bora, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 528 of the Bharatiya Nagarik Page No.# 2/2 Suraksha Sanhita (BNSS), 2023, praying for Zimma of a Truck bearing Regd. No. JK- 02-BM-4049 in respect of the order dated 09.01.2025, passed in connection with the Final report No.91/2023, dated 31.03.2023, corresponding to Gorchuk P.S. Case No.231/2022, under Sections 420/407/379 of the Indian Penal Code. 3. The learned Court below gave custody of the vehicle bearing Regd. No. JK- 02-BM-4049 to the present petitioner, who is the Power of Attorney holder. The said Power of Attorney was missing and the petitioner brought in a new Power of Attorney, which was executed in his prayer. 4. This Court is of the opinion that the seized vehicle may be given in custody of the present petitioner on the basis of the fresh Power of Attorney dated 15.07.2025. 5. Therefore, the Investigating Officer is directed to give custody of the aforesaid vehicle to the present petitioner on taking a bond of Rs.2,00,000/-. 6. The Officer-In-Charge of Gorchuk Police Station is directed to give custody of the aforementioned vehicle to the present petitioner after going through the new Power of Attorney. 7.
