The present petitioner has filed proceedings under Section 24 of the Maharashtra Rent Control Act, 1999, before the Competent Authority under the said Act for eviction against the present respondents. 2. It is the case of the respondents that the petitioner is in possession of the suit property as a gratuitous licensee. In view of the judgment of this Court in the case of Farida Amin Tharani & Anr.. ..vs.. Asma Begum Mohammed Siddique Shaikh1, the Competent Authority under the said Act does not have jurisdiction to entertain a case for eviction against a gratuitous licensee. 3. In view of the aforesaid, order dated 06.04.2026 passed by the learned Competent Authority, Rent Control Act Court, Nagpur Division, Nagpur, on application at Exhibit 16 in Rent Control New Case No.20 1 Civil Appellate Jurisdiction at Bombay WP No.4797/2018 decided on 07.08.2018 2026:BHC-NAG:9095 2 77.wp.3709.2026nn.odt of 2023 is quashed and set and the proceeding instituted by the respondents in the said case stands dismissed.
