Dhanbad, District Dhanbad. … … Respondents ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Rajesh Lala, Advocate For the Respondent(s) : AC to AG ------ 17/ 29.04.2026 By filing this writ petition, the petitioner has prayed for the following reliefs:- "(i) For issuance of an appropriate direction to the Respondent nos.1 & 2 to order for a comprehensive audit of the accounts of Jorapokhar PACS in conformity with the provisions of section 33 of the Jharkhand co- operative Societies Act, 1935, to be conducted within a time frame, by a specially constituted high level audit team. (ii) For the issuance of an appropriate writ, order or direction upon the respondent to conduct a 2026:JHHC:12852 2 full, detailed and in depth enquiry into the affairs of Jorapokhar PACS Limited, particularly from the year 1995 onwards, within which period, huge amounts of public money was defalcated from the Jorapokhar PACS which was obtained from the general public by way of deposits by the persons who were in the vortex of management of the said PACS. (iii) For issuance of appropriate direction to the Respondent no.1 & 2 to refer the matter for investigation to a high level investigating agency which must conduct investigation under the supervision of this Hon’ble Court. (iv) For a further direction to respondents to take appropriate steps to recover the defalcated amount from the persons, who have with foul intention & ulterior motive, illegally siphoned off public money/depositors money in complete disregard of the relevant law and banking principles by causing absolute breach of trust. (v) For a further direction to initiate a criminal prosecution against the persons found to have indulged in illegal/irregular diversion of the PACS funds. (vi) For issuance of appropriate direction to the Respondents to take all appropriate steps against persons involved in defalcation of funds meant to be utilized in the interest of the members of the PACS. (vii) For a further direction to the respondents to give full and fair co-operation to the existing Managing Committee of the PACS in recovering the bad loans distributed by the post Managing Committee so as to bring back the PACS into a state of smooth functioning and enable it to achieve its desired objectives." 2026:JHHC:12852 3 2. Heard learned counsel representing the petitioner and learned counsel representing the respondents. 3. After going through the prayer made in this writ petition and the grievance of the petitioner-Society, this Court is of the opinion that this writ petition is in the nature of "Public Interest Litigation (PIL)", thus I am not inclined to entertain this writ petition. 4. The petitioner - Society is directed to file a fresh Public Interest Litigation Writ Petition, if at all it wants to pursue its claim. 4.1. In the alternative, the petitioner - Society may approach the Registrar, Cooperative Society, for redressal of its grievance. 5.
