JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before the Court seeking the following prayer: (a) Issue a Writ of Mandamus directing the lower court to send the records in Criminal Appeal No.25407/2024, Annexure –L on the file of the Hon’ble LXXV Additional City Civil and Sessions Judge at Bangalore, and direct the presiding officer of CCH-75 to decide the appeal expeditiously within 60 days as prescribed in the statute under section 12(5) of PWDV Act. (b) Issue a Writ of Mandamus directing the trial court in Criminal Misc. Petition No.323/2012, dated 02.12.2024, Annexure – j on the file of Hon’ble JMFC Traffic Court-1, Mayohall at Bangalore, with necessary clarification that the Petitioner is entitled for execution of the interim maintenance order in Crl.Misc.No.159/20224 before Hon’ble Judicial Magistrate Traffic Court-1, Mayohall at Bangalore . Annexure – F. (c) Direct the respondent No.1 to pay monthly maintenance 40,000/-; from the date of writ petition till further orders to the Petitioner No.1. (d) Direct the respondent No.1 to pay the maintenance of Rs,.10,46,671/- by way of arrears of maintenance to the Petitioner No.1 including medical expenses and care to be taken to the Petitioner No.1 till her death. - 4 - HC-KAR NC: 2026:KHC:22314 WP No. 12400 of 2026 (e) Direct the Respondents to abstain himself from interfering in the peaceful Possession and enjoyment of Petitioner No.1 in the Property bearing No.3/5, now presently comes under the jurisdiction BBMP, Hoodi Village Property No.3/5, BBMP ‘B’ Form Sl.No.2084, totally measuring 4900 square feet and constructed 1400 square feet ground floor R.C.C. roofed house as a right of residence, with a further direction to Mahadevapura police to implement the order. (f) Pass such other order or orders as this Hon’ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity.” 2. Learned counsel for the petitioners Sri. Chandrakanth R Goulay, restricts his prayer to prayer No.1, which is seeking a direction to the concerned Court for expeditious disposal of the proceedings instituted by the wife under the Provisions of the Domestic Violence Act. 3. In the light of the mandate of the statute that these proceedings must be expeditiously concluded and the proceedings pending for the last 14 years, I deem it appropriate to infuse finality into the proceedings with a direction to the concerned Court to conclude the - 5 - HC-KAR NC: 2026:KHC:22314 WP No. 12400 of 2026 proceedings with an outer limit of 3 months from the date of receipt of the copy of this order. 4. Accordingly, the Writ Petition is disposed of. 5. It is made clear that the parties to the lis shall co-operate for the conclusion of the proceedings. In the event of non-co-operation by any of the parties, the concerned Court is at liberty to pass necessary orders in accordance with law, towards compliance with the direction. 6.
