Order No.2 / Dated : 28.01.2026.
Heard both the sides.
The petitioner, above-named is in custody since 12.07.2025 in connection with Hiranpur (Pakur) P.S. Case No.74 of 2025 for the offences registered under Sections 103(1), 238 read with Section 3(5) of the BNS, 2023 has prayed for regular bail.
Informant is the father of the deceased. As per the FIR, on 10.07.2025 in the night/ early morning at 4:00 a.m., he received information that six named accused persons including the petitioner under a criminal conspiracy to wreck vengeance because of past enmity had done to death of his son [Rupesh Yadav] and threw his dead-body near a pond. The deceased was a cleaner in a Hywa truck and the Driver of the said vehicle, Digambar Yadav informed that Rita Devi had called him by making three telephonic calls. It is alleged that earlier on 09.07.2025, the deceased was threatened to be killed by the accused persons.
It is submitted by the learned Sr. counsel on behalf of petitioner that there is no direct eye-witness to the incidence and the entire family members have been implicated in the case merely on suspicion. The motive of offence has also not been stated. Further, the petitioner is not even named in the written report. However, in the formal FIR, she has been made accused.
Learned A.P.P. for the State opposed the prayer for bail. It is submitted that the last call made to the deceased was by this petitioner

and on being called by her, he (deceased) left the Hywa Truck and thereafter, his dead-body was found in the morning. The genesis of the offence is that there was love-affair between the deceased and the petitioner for which, her family members were threatening the deceased since before the incidence.
There is no eye witness to the incidence and the case rests on sketchy circumstantial evidence. On the one hand, it is stated that the petitioner had love-affair and on the other, it is stated that Petitioner was involved in the conspiracy to call the deceased, after which, he was found to be dead.
Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
