---- 2/04.02.2026 Heard learned counsels for petitioners and for State. 2. The petitioners are apprehending their arrest in connection with Garhwa P.S. Case No.362 of 2025, for offence registered under section 126(2), 115(2), 118(1), 118(2), 109(1), 303(2) 352, 351(2) and 3(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Garhwa. 3. Learned counsels for petitioners, appearing in respective cases, submit that the petitioners are innocent and have falsely been implicated in this case due to land dispute between the parties. They further submit that the informant and his associates were aggressors party and the petitioners and the informant side are the agnets.
They next submit that members of the petitioners’ side have also lodged the FIR being Garhwa P.S. Case No.363 of 2025 against the informant and others for the same incident and there are general and omnibus allegations against all the petitioners and the allegations are made that all have assaulted. 4. Learned State counsel as well as the learned counsel for the informant jointly oppose the prayer and submit that allegations are there of assault and pursuant to that, Minta Devi has died after 23 days in the hospital. In the FIR itself it has been stated at the bottom of the first paragraph that Upendra Choudhary, Sushil Choudhary, Mukhdev Choudhary are doing daily labour work in another city which prima facie suggest that they were not present on the spot, however, in the case diary, it has been proved saying that Upendra Choudhary is the main assailant and there are case and counter case between the parties and there are general and omnibus allegations against all the family members of assault, I am inclined to grant anticipatory bail to petitioners. 6. Accordingly, petitioners, above named, are hereby directed to surrender before learned court within four weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa P.S. Case No.362 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023. ( Sanjay Kumar Dwivedi, J.) 04.02.2026 SI/
