1. By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks the following reliefs:
“a. Pass an order interpreting the exercise of power by the designated authority, conferred under the statute namely the Custom Act, 1962 and not by any other authority,
b. Further interpretation of section 135AA of Customs Act, 1962 and its applicability, This is a digitally signed order. c. Also interpret applicability of legal provisions in any act or omissions falling under two different statutes, the interpretation of Custom Act
d. Issue an appropriate writ of Mandamus declaring forwarding of the complaint by the Customs Department to the Special Cell, Delhi Police, arbitrary, without jurisdiction and contrary to the statutory scheme of the Customs Act, 1962 e. Quash the F.I.R. no. 65/2026 dated 10.03.2026 registered at Special Cell, New Delhi
f. Quash All consequential proceedings.
g. Pass any such order/orders/writ as this Hon’ble Court may deem fit and proper.”
2. After some arguments, and upon instructions, learned senior counsel for the petitioner seeks to withdraw the present petition with liberty to file the same afresh in accordance with law.
3. The present petition, alongwith pending applications, is dismissed as withdrawn with liberty as prayed for.
