Also heard the learned Additional Public Prosecutor appearing for the State. This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 whereby the petitioner, namely, Rafikul Islam @ Vaista, has prayed for releasing him on bail after he were arrested on 25.02.2026 in Page No.# 2/2 connection with Special NDPS Case No.23/2026 under Section 21(b) of NDPS Act pending before the learned Additional Sessions Judge (FTC). Barpeta (arising out of Howly P.S. Case No. 20/2026, under Section 21(b)/29 of NDPS Act. The allegation against the petitioner is that an intermediate quantity of suspected heroin amounting to 110.02 gm was recovered from the petitioner. He was arrested on 25.02.2026 and by now has spent 202 days in custody. The investigation of the case is also over and the charge-sheet has also submitted. Having regard to the above, further detention of the petitioner may not be necessary. Therefore, the prayer for bail is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing a bail bond of Rs. 50,000/- with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge, First Track Court, Barpeta.
