1. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.73/2025 registered at Police Station – Jutmil Raigarh, District - Raigarh (C.G.) for the offence punishable under Sections 109(1) of Bharatiya Nyaya Sanhita, 2023 and Section 25 of Arms Act.

The prosecution's case, in brief, is that the present applicant assaulted Mukesh Khadiya with an axe on the head, throat, neck, ear, and arm, with the intention to cause his death, as a result of which the injured person sustained grievous injuries. Upon the complaint, the police registered an offence under Section 109(1) of the BNS, 2023, and Section 25 of the PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.02.06 18:19:20 +0530
2 Arms Act, and arrested the applicant.

Learned counsel for the applicant argued that the applicant is innocent and has been falsely implicated in the present case. He further submitted that the applicant has no previous criminal antecedents. It was also submitted that the trial is in progress and, as regards the status of the trial, out of 14 witnesses, 6 have been examined. The charge-sheet has been filed in the case, and the applicant has been in jail since
14.03.2025. Since the trial is likely to take a considerable time for its conclusion, he prayed for grant of bail.
4. On the other hand, learned State counsel opposed the bail application, submitting that the charge-sheet has already been filed. She further submitted that the applicant caused injuries to the injured person with an axe (farsa) on the head, as a result of which the injured sustained five lacerated wounds on his person, including in the occipital region, which were found to be grievous in nature and dangerous to life. Therefore, the applicant is not entitled to be released on bail.
5. I have heard learned counsel for the parties and perused the documents available on record.

Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that the applicant caused injuries to the injured person with an axe (farsa) on the head, as a result of which the injured sustained five lacerated wounds on his person, including in the occipital region, which were found to be grievous in nature and dangerous to life, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
7. Accordingly, the bail application of the applicant - Dinesh Sahu involved
3 in Crime No.73/2025 registered at Police Station – Jutmil Raigarh, District - Raigarh (C.G.) for the offence punishable under Sections 109(1) of Bharatiya Nyaya Sanhita, 2023 and Section 25 of Arms Act, is rejected at this stage.
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
