The complainant has filed the present complaint alleging willful disobedience of the order dated 29.11.2024 passed by the learned Single Judge of this Court in Writ Petition No.22216/2023 (LA-RES). In terms of the said order, it was open for the petitioner to file a representation along with the relevant documents relating to land acquisition to enable the respondents to take a decision in the said matter. 2. The complainant had made a representation. The same was not disposed of. In the circumstances, the complainant filed a complaint, CCC No.273/2025 (Civil), which was disposed of by - 3 - HC-KAR NC: 2026:KHC:23370-DB CCC No. 176 of 2026 order dated 25.03.2025 directing the accused to take a decision within a period of eight weeks from the said date. 3. The accused has filed a compliance affidavit inter alia enclosing therewith an endorsement dated 18.04.2026, whereby the complainant's representation has been disposed of. The said endorsement explicitly states that no proceedings for land acquisition were initiated in respect to the subject land [land measuring 2 acres and 17 guntas of Kallenakuppe Village, Maralwadi Hobli, Kanakapura Taluk, Ramanagara District] and as the said land was the subject matter of the gift deed [Dana Patra] in favour of the Health Department executed on 02.11.2004. 4. The learned counsel for the complainant submits that the said endorsement is without merit as the accused has not produced any registered document to establish that his father had gifted the subject land to the Health Department. We cannot engage ourselves with the said controversy in the present petition. The limited direction issued by the learned Single Judge was for the accused to consider the complainant's representation, which has been done. - 4 - HC-KAR NC: 2026:KHC:23370-DB CCC No. 176 of 2026 5. In view of the above, the complaint is closed. 6. We however clarify this would not preclude the complainant from availing substantive remedies including in respect of the endorsement dated 18.04.2026. 7.
