The writ petition is filed with a prayer to change the name of the father in the birth certificate of the child, Miss Aarti C Pawadi. The name of the father is mentioned as Sri.Chetan S.Pawadi. It is contended that the correct name of the father of the child is Sri.Kumar Chetan and not Sri.Chetan S.Pawadi. Hence, the petitioner, who is represented by her natural guardian, her father Sri.Kumar Chetan has made representation to the respondent. However, the respondent has issued an endorsement dated 08.07.2024 (Annexure-'F' to the writ petition). Section 15 of the Registration of Births and Deaths Act, 1969, reads as under:- "15. Correction or cancellation of entry in the register of births and deaths.—If it is proved to the satisfaction of the Registrar that any entry of a birth or death in any register kept by him under this Act is erroneous in form or substance, or has been fraudulently or improperly made, he may, subject to such rules as - 4 - HC-KAR NC: 2026:KHC:16957 WP No. 20840 of 2025 may be made by the State Government with respect to the conditions on which and the circumstances in which such entries may be corrected or cancelled, correct the error or cancel the entry by suitable entry in the margin, without any alteration of the original entry, and shall sign the marginal entry and add thereto the date of the correction or cancellation." 3. Thus, the respondent in this case is required to make an enquiry and if it comes to the conclusion based on the documents submitted by the petitioner, who is minor represented by her natural guardian, her father Sri Kumar Chetan, that the correct name of the father of the minor child is Sri Kumar Chetan, then in that event, the respondent is to correct the name in the birth certificate. Section 15 of the Registration of Births and Deaths Act, 1969 empowers to do so. The request cannot be rejected on the ground that the name Sri.Chetan S.Pawadi., as found in the birth register is substantially different from Sri.Kumar Chetan. The purpose of Section 15 of the Registration of Births and Deaths Act, 1969 is to correct the errors in the birth certificate of any person, and the power to do so is vested with the respondent. - 5 - HC-KAR NC: 2026:KHC:16957 WP No. 20840 of 2025 4. For the aforementioned reasons, the writ petition is disposed of. The impugned endorsement dated 08.07.2024 issued by the respondent at Annexure-'F' is set aside. 5. Respondent is directed to make the necessary enquiry and pass appropriate orders in accordance with law.
