By way of this writ petition, the petitioner has assailed the transfer order dated 02.07.2026, (Annexure P-3), in terms whereof, she has been transferred from GPS Lukanu, EB Gopalpur-I to GPS Chula Thach, EB Seraj-II.

Learned counsel for the petitioner has submitted that the father-in-law of the petitioner contested the election of the Member of Municipal Council of Sarkaghat and he was elected on 17.05.2026. According to him, the impugned transfer
order is a result of colourable exercise of power as the petitioner has been transferred on the basis of a DO Note.

On the other hand, learned Assistant Advocate General submitted that in terms of the averments made in the writ petition, the petitioner is serving at the present station since October, 2022 and as her stay at the said station is complete, there is no illegality in the transfer order. He also submitted that though it is alleged in the writ petition that the transfer of the petitioner was on the basis of a DO Note, yet, neither any detail of DO Note has been given nor it is mentioned as to who got the DO Note issued. He, thus, submitted that all the allegations made in the petition are vague.

Having heard learned counsel for the petitioner as also learned Assistant Advocate General, in the light of the fact that the petitioner has already completed her normal tenure at the present station, no interference therewith is required. However, in light of the fact that the learned counsel for the petitioner submitted that the husband of the petitioner is also serving in PNB Bank at Hamirpur and their child is presently studying in +2 Class, this petition is disposed of with the
discussion that the petitioner may approach the Competent Authority for her adjustment at some other station by filing a
3 representation within a week from today. In case such representation is filed by the petitioner, then, the same shall be decided by the Authority within two weeks from the date of receipt thereof. Till then the petitioner shall not be forced to join the station, to which, she stands transferred and she may avail the kind of leave due to her.

Pending miscellaneous applications, if any, also stand disposed of.
