By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for following relief: "Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to conduct an enquiry into the illegal entry and construction attempted by respondent nos. 5 to 8 with the help of police over petitioner's araji khatauni no. 557 M, area 0.0843 hectare, situated in Village Kulesara, Pargana and Tehsil Dadri, District Gautam Buddh Nagar, and to restrain them from raising any construction thereon without authority of law." 3. In our considered view, the relief is in the nature of injunctions arising out of a pure civil dispute which may involve disputed questions of fact and hence, petitioner may avail remedy of civil suit, if so advised. Accordingly, we decline to grant indulgence in the matter at this stage. 4. Subject to aforesaid liberty, this petition is consigned to records.
